Vehicles & Thresholds Louisiana Law Covers
Louisiana’s lemon law covers passenger motor vehicles, personal watercraft and ATVs used for personal purposes, and the chassis and drive train of motor homes, all sold in Louisiana. The lemon presumption triggers after four or more repair attempts for the same nonconformity, or 45 or more cumulative out-of-service calendar days, within the warranty term or one year of original delivery, whichever is earlier. For motor homes, the threshold rises to 90 or more cumulative days, and written notice to the manufacturer is required before the final repair opportunity. The law covers new vehicles, demo vehicles, and vehicles still under a factory warranty. Used vehicles sold with full disclosure of known defects fall outside these protections.
Defects must be reported before the warranty expires or within one year of original delivery to preserve your rights. Accurate records of every repair visit, including dates, mileage, and the work performed, are essential to meeting the threshold requirements. Remedies Available Under Louisiana Lemon Law
When the statutory threshold is met, the manufacturer may be required to either replace the vehicle with a comparable new one or refund the full purchase price, including collateral costs such as sales tax, license fees, and registration fees, less a reasonable use allowance. For leased vehicles, the refund remedy may cover lease payments made up to the point of return, provided the lessor agrees to terminate the lease.
Louisiana law provides additional protections worth knowing:
- Rental reimbursement (RS 51:1948): When repairs exceed ten work days or the same defect has been tendered twice, the manufacturer may be required to reimburse rental vehicle costs at up to $20 per day. This applies for the warranty period or two years, whichever comes first, and does not apply to personal watercraft, ATVs, or motor homes.
- Attorney fee shifting (RS 51:1947): If judgment is entered in your favor, the manufacturer may be responsible for reasonable attorney fees you actually incurred. This is one reason pursuing a formal claim can be more financially accessible than most people expect.
Manufacturers frequently offer goodwill settlements that require you to waive legal rights. These offers can sound reasonable without being fair.
