When Your Used Vehicle May Still Qualify for Lemon Law Protection

Most people assume Louisiana’s lemon law is strictly for new cars. That’s not quite right. A used vehicle can qualify if the defect was reported before the manufacturer’s warranty expired or within one year of the vehicle’s original delivery to its first owner, whichever comes first. The law, La. R.S. 51:1941 through 51:1948, covers passenger vehicles sold in Louisiana on or after September 1, 1984, and it gives you enforceable rights when a manufacturer can’t fix a substantial defect after a reasonable number of repair attempts.

A qualifying nonconformity is any defect or malfunction that substantially impairs a vehicle’s use, market value, or both. If your used car had one of these problems and the warranty was still active when you reported it, the lemon law may apply to your situation.

Which Used Vehicles I Handle

Not every used-car dispute fits within a lemon law claim, and I’m direct about that from the start. My lemon law practice covers new vehicles, demo vehicles, and used vehicles still under a remaining factory warranty. Those situations preserve the legal footing the statute requires.

When the State Lemon Law Doesn’t Reach: Redhibition & Magnuson-Moss

When a used vehicle falls outside the state lemon law’s thresholds, two other legal frameworks often apply. The Magnuson-Moss Warranty Act is a federal law that can cover vehicles purchased with a manufacturer’s express warranty, whether new or used, even when the state statute’s specific criteria aren’t met. A consumer who prevails under Magnuson-Moss can recover attorney fees from the manufacturer.

Louisiana redhibition law offers a separate avenue, allowing a buyer to seek rescission of a sale or a reduction in the purchase price when a vehicle carries hidden defects the seller knew or should have known about. The Louisiana lemon law doesn’t restrict other remedies available under applicable law, so a redhibition claim and a lemon law claim can run alongside each other when the facts support both.
